Terms of Service

Effective Date: November 6, 2026
Last Updated: November 6, 2026

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 22) THAT AFFECT HOW DISPUTES ARE RESOLVED, A RELEASE AND ASSUMPTION OF RISK (SECTION 20), AND LIMITATIONS ON OUR LIABILITY (SECTION 19).

1. Agreement to These Terms

These Terms of Service ("Terms") are a legal agreement between you and Benjamin Sykes, an individual residing in Florida ("Covenant," "we," "us," or "our"), governing your use of the Covenant mobile application, website, and related services (together, the "Service").

By creating an account, checking the acceptance box, or using the Service, you agree to these Terms, our Privacy Policy, and our Subscription Terms, which are incorporated by reference. If you do not agree, do not use the Service.

2. Eligibility

To use Covenant, you must:

(a) be at least 18 years old (or the age of majority where you live, if higher);
(b) be legally able to enter into a binding contract;
(c) use the Service only with your spouse or committed partner, who must also meet these requirements;
(d) not be prohibited from using the Service under applicable law; and
(e) provide accurate account information and keep it current.

We may require age or identity verification at any time. We may suspend or terminate any account we reasonably believe belongs to someone under 18.

3. What Covenant Is — and What It Is Not

Covenant is an educational and relationship-enrichment tool. It offers assessments, games, conversation prompts, daily readings, and messaging features designed to help spouses connect.

COVENANT IS NOT COUNSELING, THERAPY, OR TREATMENT. Covenant does not provide marriage or family therapy, psychological or psychiatric services, mental health treatment, medical advice, legal advice, or pastoral counseling, and it is not a substitute for any of them. Benjamin Sykes, its founders, employees, and contributors are not licensed counselors, therapists, psychologists, psychiatrists, social workers, physicians, or mental health providers, and nothing in the Service creates a counselor–client, therapist–patient, or any other professional relationship.

All content in the Service is for general informational, educational, and entertainment purposes only. You should consult a qualified, licensed professional about any mental health, relationship, medical, legal, or safety concern.

4. No Guarantee of Results

We believe Covenant can help strengthen a marriage, but we cannot fix a marriage, and we do not promise any outcome. We do not guarantee that use of the Service will improve your relationship, lead to reconciliation, or prevent conflict, separation, or divorce. The health of your marriage depends on many factors outside our control. Every decision you make about your relationship, including decisions made after using Covenant's content, is your own, and you are solely responsible for it.

5. Faith-Based Content

Portions of Covenant reflect a Christian perspective, including Scripture-based readings and spiritual-gifts content. This content is offered for personal reflection and encouragement. It is not pastoral counsel, church discipline, or theological authority, and it does not represent the position of any church or denomination. You are free to engage with it or not, and you should seek guidance from your own pastor or faith leaders on spiritual matters.

6. Assessments Are Not Diagnostic

Covenant's assessments (including Love Language, Attachment Tendencies, and Spiritual Gifts assessments) are self-reflection tools. They are not clinically validated psychological tests, and their results are not diagnoses, clinical findings, or professional evaluations of you, your spouse, or your relationship. Results depend entirely on the answers given and should not be relied on to make significant life, health, or legal decisions.

7. Safety, Crisis, and Abuse

Covenant is not an emergency service and is not monitored in real time.

  • If you or anyone else is in immediate danger, call 911 (or your local emergency number).
  • If you are having thoughts of suicide or self-harm, call or text 988 (Suicide & Crisis Lifeline).
  • If you are experiencing domestic violence, abuse, or coercion, contact the National Domestic Violence Hotline at 1-800-799-7233, or text START to 88788.

Covenant is designed for relationships in which both spouses participate freely and safely. It is not appropriate for relationships involving abuse, violence, threats, or coercive control, and it should not be used as a tool to address those situations. You agree never to pressure, threaten, or require your spouse to use Covenant or any of its features, to answer any question, or to send any content. If you believe your device or account is being monitored by someone who may harm you, consider using a safe device to seek help.

8. Your Shared Couple Space

Linking accounts. Covenant connects your account with your spouse's account. Once linked, content you share in the couple space (including assessment results, game answers, messages, and media) may be visible to your spouse. Do not share anything in Covenant that you do not want your spouse to see.

Your spouse's actions. We do not control and are not responsible for what your spouse does with anything you share, including saving, copying, screenshotting, forwarding, or disclosing it.

Unlinking, separation, and divorce. Either spouse may unlink or terminate their account at any time as described in the Service. Unlinking may not remove content your spouse has already viewed or captured. Covenant is not a record-keeping service and is not designed to preserve messages or content as evidence. We will not mediate disputes between spouses, and we will not provide one spouse access to the other spouse's account or data except as required by law.

9. Private and Disappearing Messages and Media

Covenant offers messages, photos, and videos designed to be deleted after they are viewed or after a set period ("Disappearing Content"). By using Disappearing Content, you understand and agree that:

(a) Recipients can capture it. Your spouse, or anyone with access to their device, may save Disappearing Content by screenshot, screen recording, a second camera, third-party software, or other means. We may attempt to detect or notify you of some captures, but we cannot prevent capture and do not guarantee that any notification will occur.

(b) Deletion is not instantaneous or absolute. Disappearing Content is stored on our servers or our service providers' servers temporarily to deliver it. Deletion may not be immediate, and residual copies may remain for a limited period in transit, in caches, or in backup systems, as described in our Privacy Policy. Content may also remain on a device if it was captured or cached there.

(c) Legal obligations may require retention. We may preserve content when required by law, legal process, or to protect the safety of any person, including where content appears to involve the exploitation of a minor.

(d) You alone decide what to send. You are solely responsible for choosing to create and send any content, including intimate or sensitive images, videos, or messages.

Send only content you would be comfortable existing permanently. TO THE FULLEST EXTENT PERMITTED BY LAW, COVENANT IS NOT RESPONSIBLE OR LIABLE FOR ANY SAVING, COPYING, SHARING, PUBLICATION, OR DISTRIBUTION OF YOUR CONTENT BY YOUR SPOUSE OR ANY OTHER THIRD PARTY.

10. Your Content

Ownership. You own the content you create and send through the Service ("User Content").

License to us. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your User Content solely as needed to operate, secure, and provide the Service to you and your spouse, and to comply with law. This license ends when your User Content is deleted from our systems, except as described in Section 9(c) and our Privacy Policy.

Your responsibility. You represent that you have all rights needed to share your User Content, that any person depicted in it has consented, and that it does not violate these Terms or any law. We do not endorse any User Content and are not responsible for it.

11. Prohibited Conduct

You agree not to:

(a) use the Service if you are under 18, or allow anyone under 18 to use your account;
(b) create, send, request, or store any content that depicts a minor in a sexual or sexually suggestive manner;
(c) send intimate images or videos of any person without that person's consent, or send intimate content to anyone other than your consenting spouse;
(d) harass, threaten, stalk, intimidate, coerce, or abuse any person, or use the Service to monitor or control your spouse against their will;
(e) impersonate anyone or access another person's account without authorization;
(f) upload malware or interfere with, disrupt, reverse engineer, scrape, or attempt to gain unauthorized access to the Service or its systems;
(g) use the Service for any commercial purpose or any unlawful purpose; or
(h) help anyone else do any of the above.

12. Intimate Content, Child Safety, and Removal Requests

Zero tolerance for child sexual abuse material. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and to law enforcement as required by law, may preserve related information, and will terminate associated accounts.

Non-consensual intimate imagery. If an intimate image or video of you was shared through Covenant without your consent, you may request its removal by contacting covenant@covenantmarriageapp.com or using Us → Settings → Help & Safety. Please include your name, contact information, a description sufficient for us to locate the content, and a statement that the content was shared without your consent. We will remove valid requests as soon as possible and within 48 hours of receiving them, and will make reasonable efforts to remove known identical copies, as required by applicable law.

13. Reporting, Moderation, and Enforcement

You may report content or conduct that violates these Terms using Us → Settings → Help & Safety or covenant@covenantmarriageapp.com, and you may block another user where that feature is available. We are not obligated to monitor User Content but may review, remove, or restrict content and may suspend or terminate accounts at our discretion, with or without notice, if we believe these Terms or the law have been violated or that someone's safety is at risk.

14. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for securing your device, including using a passcode and keeping your operating system updated. You are responsible for all activity on your account. Notify us immediately at covenant@covenantmarriageapp.com if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account resulting from your failure to safeguard your credentials or device.

15. Subscriptions and Payments

Paid features, free trials (including any free trial or offer code), billing, renewal, cancellation, and refunds are governed by our Subscription Terms. Purchases made through the Apple App Store or Google Play are also subject to those platforms' terms, and refunds for those purchases are handled by the platform.

16. Our Intellectual Property

The Service, including its design, software, text, assessments, games, readings, graphics, logos, and the "Covenant" name and flame logo, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. Some content, including Scripture text, is licensed from third parties and is subject to their terms: Scripture quotations are from the King James Version (public domain). You may not copy, distribute, modify, or create derivative works from the Service except as permitted by law.

17. Third-Party Services

The Service may rely on or link to third-party services (such as app stores, payment processors, hosting providers, and content licensors). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

18. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL IMPROVE YOUR RELATIONSHIP OR PRODUCE ANY PARTICULAR RESULT; (B) THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (C) DISAPPEARING CONTENT WILL BE DELETED FROM ALL SYSTEMS OR DEVICES OR WILL NOT BE CAPTURED BY OTHERS; (D) ANY DATA WILL BE FREE FROM UNAUTHORIZED ACCESS; OR (E) ANY CONTENT, ASSESSMENT, OR RESULT IS ACCURATE, COMPLETE, OR RELIABLE.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) IN NO EVENT WILL BENJAMIN SYKES OR ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, OR SERVICE PROVIDERS (THE "COVENANT PARTIES") BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES FOR EMOTIONAL DISTRESS, LOSS OF CONSORTIUM, RELATIONSHIP HARM, SEPARATION, DIVORCE, REPUTATIONAL HARM, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) THE COVENANT PARTIES WILL NOT BE LIABLE FOR ANY LOSS OR HARM ARISING FROM: (i) THE CONDUCT OF YOUR SPOUSE OR ANY OTHER USER OR THIRD PARTY; (ii) ANY SAVING, CAPTURE, SHARING, OR DISTRIBUTION OF YOUR CONTENT BY OTHERS; (iii) UNAUTHORIZED ACCESS TO YOUR DEVICE OR ACCOUNT; OR (iv) CRIMINAL ACTS OF THIRD PARTIES, INCLUDING HACKING OR DATA BREACHES, DESPITE OUR REASONABLE SECURITY MEASURES.

(c) THE COVENANT PARTIES' TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).

(d) THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND US AND APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

(e) NOTHING IN THESE TERMS LIMITS OR EXCLUDES LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD WHERE SUCH LIMITATION IS PROHIBITED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

20. Assumption of Risk and Release

You understand that discussing personal, emotional, sexual, and spiritual matters with your spouse can lead to difficult conversations, disagreements, and emotional discomfort, and that sending sensitive or intimate content carries inherent risks, including the risk that it will be captured or shared. You voluntarily assume these risks.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE THE COVENANT PARTIES FROM ALL CLAIMS, DEMANDS, AND DAMAGES OF EVERY KIND, KNOWN AND UNKNOWN, ARISING OUT OF OR CONNECTED WITH (a) DISPUTES BETWEEN YOU AND YOUR SPOUSE OR ANY OTHER USER, AND (b) THE CONDUCT OF YOUR SPOUSE OR ANY THIRD PARTY, INCLUDING THE CAPTURE OR DISTRIBUTION OF YOUR CONTENT. If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You waive any similar law in any other jurisdiction.

21. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Covenant Parties from and against any claims, liabilities, damages, losses, fines, and expenses, including reasonable attorneys' fees, arising out of or relating to: (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any law or the rights of any other person, including your spouse. We may assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with our defense.

22. Dispute Resolution: Binding Arbitration and Class Action Waiver

(a) Informal resolution first. Before starting arbitration, you agree to contact us at covenant@covenantmarriageapp.com with a written description of your claim and your requested resolution, and to try in good faith to resolve it informally for at least sixty (60) days. We agree to do the same before starting arbitration against you.

(b) Agreement to arbitrate. Except as provided in Section 22(e), any dispute, claim, or controversy arising out of or relating to these Terms or the Service, including the scope or enforceability of this arbitration agreement, will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, and not in court. The arbitration will take place in Duval County, Florida, or remotely by video or written submission, at your election for claims under $10,000. Payment of arbitration fees will be governed by the administrator's rules. Judgment on the award may be entered in any court with jurisdiction. This agreement is governed by the Federal Arbitration Act.

(c) Class action and jury trial waiver. YOU AND COVENANT EACH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU AND COVENANT EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may award relief only to the individual party seeking it. If this class waiver is found unenforceable as to any claim, that claim will be severed and decided in court, and not in arbitration.

(d) Mass arbitration. If twenty-five (25) or more similar arbitration demands are filed by or with the assistance of the same law firm or coordinated group, the demands will be administered in batches of up to 25 per batch, with one batch proceeding at a time, to the extent permitted by the administrator's rules.

(e) Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek injunctive relief in court for infringement or misuse of intellectual property.

(f) Opt out. You may opt out of this arbitration agreement by emailing covenant@covenantmarriageapp.com within thirty (30) days after first accepting these Terms, with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

(g) Time limit. To the extent permitted by law, any claim must be brought within one (1) year after it arises, or it is permanently barred.

23. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, and by applicable federal law. For any matter not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in Duval County, Florida.

24. Termination

You may stop using the Service and terminate your account at any time through Us → Account → Delete account. We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your license to use the Service ends. Sections 9, 10 (as to your responsibility), 12, and 16 through 27 survive termination.

25. Changes to the Service and These Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. Your continued use of the Service after changes take effect means you accept the updated Terms. Changes to Section 22 will not apply to disputes that arose before the change.

26. Apple App Store Terms

If you downloaded Covenant from the Apple App Store: (a) these Terms are between you and us only, not Apple, and we, not Apple, are solely responsible for the Service; (b) Apple has no obligation to provide maintenance or support; (c) in the event of any failure of the Service to conform to an applicable warranty, you may notify Apple for a refund of the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; (d) Apple is not responsible for addressing any claims relating to the Service, including product liability claims, claims of failure to conform to legal requirements, and consumer protection or privacy claims; (e) Apple is not responsible for any third-party claim that the Service infringes intellectual property rights; (f) you represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties; and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

27. General Terms

Entire agreement. These Terms, the Privacy Policy, and the Subscription Terms are the entire agreement between you and us about the Service.
Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions will remain in full effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign them without restriction, including in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
Electronic communications. You consent to receive notices and agreements electronically, and these satisfy any legal requirement that they be in writing.
Headings. Headings are for convenience only and have no legal effect.

Subscription Terms

This page summarizes Covenant's subscription terms. It does not replace the full Terms of Service, which governs in the event of any difference.

Plans

Monthly: $9.99/month — automatically renews monthly until canceled.
Annual: $79.99/year — automatically renews annually until canceled.

One subscription covers the subscribing user and their invited spouse/partner account. A linked partner does not obtain independent ownership of the purchasing user's subscription.

Automatic Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period through your Apple ID subscription settings. You authorize that platform to charge the applicable subscription price at each renewal.

Deleting Covenant, ceasing to use Covenant, or unlinking a spouse does not automatically cancel a subscription — cancellation must happen through the applicable platform's subscription-management mechanism.

Free Trials and Offer Codes

If a free trial or offer code is available to you, Apple shows its length before you confirm. Unless you cancel in your Apple ID subscription settings at least 24 hours before it ends, your subscription begins and renews under the automatic-renewal terms above. You can cancel anytime in Settings → your name → Subscriptions on your iPhone.

Cancellation and Refunds

Canceling prevents future renewal but does not necessarily terminate access already purchased for the current billing period. Refund eligibility is determined by Apple, Google, applicable law, or another payment provider, depending on how the purchase was made. Nothing here eliminates refund or consumer rights that cannot legally be waived.
